First Coast NBC ABC News reported last week on a fatal car wreck in Clay County that involved multiple vehicles and shut down southbound lanes of Highway 301 for a period of time on the morning of Tuesday, October 6.
According to the Clay County Sheriff’s Office, the crash happened just south of County Road 218 right around 6:00 a.m. Drivers were urged to take State Route 16 east to Blanding Boulevard as an alternate route for their commute into the nearby city of Jacksonville, as both the north and south lanes of US 301 were shut down by the accident for a couple hours.
The Florida Highway Patrol traffic crash report website stated the crash involved four vehicles and that one person was pronounced dead at the scene. According to their investigation, a vehicle traveling north crossed the median and hit a vehicle headed south. Two other vehicles were involved in the wreck, presumably after the first two hit each other.
Clay County Fire Rescue tweeted that they were working the wreck and that it was located at 1120 US Highway 301, just south of County Road 218. They asked drivers to be aware and move over for emergency vehicles as needed.
Fleeing from the police is against the law in many states and Florida is no exception. Prior to 2003, however, the charge was only a misdemeanor. Since 2003, a person who is willfully refusing to stop for a law enforcement officer is a third-degree felony offense. This is the case regardless of whether the police...
Under Florida law, there are two ways that a person can be charged if the police or prosecutors believe that they were driving in a manner that put other people’s lives, health, or property in danger. The first charge is simply a traffic violation. It is a citation for careless driving. Being found guilty of...
In most accident cases, fault is clearly established because one of the drivers failed to obey a traffic law or rear-ended the other vehicle. However, when the driver has suffered a medical emergency, liability is not so simple. Most states recognize the “sudden medical emergency” defense in a car accident. The thought is that the...

Car accidents occur every day in South Florida. While it already may not make sense that Florida is one of the few states without a cell phone/texting ban while driving, it should make less sense now. The Sun Sentinel recently released a report indicating that, in several Florida cities and counties, fatal Florida car crashes took place due to careless and distracted driving....

On Tuesday, December 13th, the National Transportation Safety Board (NTSB) called for the first ever nationwide ban on cell phone use while driving. If approved, this would include the use of cell phones and text messaging from all devices while driving. Although different states have certain cell phone laws prohibiting handheld devices for all age...

Due to Florida’s no-fault laws, all drivers are required to carry personal injury protection (PIP) and property damage liability (PDL) insurance. Your car repairs would be covered by either a claim filed against the at-fault driver’s property damage liability policy or a claim filed with your collision coverage policy. However, collision coverage is an optional...
