Florida Driving, Tire Safety, and Defective Tires

Whatever you drive on Florida's roadways—car, truck, mini-van, or SUV—your tires are a critical component of your vehicle's driving safety. Tires are, quite literally, the rubber that comes between you and the road. Consumers pay a lot of attention to vehicle safety features and ratings. That's all important.

But the importance of tire quality, integrity, and performance in preventing serious and fatal highway accidents should not be overlooked.

South Florida drivers know our heavily traveled interstates, highways, city streets, and scenic roads can be challenging to navigate. The ability to safely maneuver and stop your vehicle is essential to avoiding traffic accidents. Tires play a crucial role in how your auto handles—under normal conditions, in bad weather, and when the unexpected happens.

Unfortunately, when a defective tire malfunctions, there is often no warning.

Tire Defects and Tire Recalls

Defective tires are a major concern of consumer safety advocates and industry watchdogs, who point to their involvement in numerous traffic accidents and fatalities. A defective tire can suddenly come apart at the treads or blow out, sending the vehicle spinning out of control.

In recent years, high-profile defective tire cases and the deadly car accidents attributed to defective tires have made news headlines. The Bridgestone Firestone mandatory tire recall in 2000 brought the issue of defective tires to the national public spotlight, when drivers of SUVs such as the Ford Explorer were hurt or killed in rollover accidents. Multiple lawsuits arose, pointing to the failure of the tires involved in those traffic accidents.

However the problem of defective tires and tire safety did not end with the Bridgestone Firestone recall in 2000. Tire recalls continue to be issued by manufacturers and dealers, and government safety and regulatory groups continue to investigate problems with tires. The National Highway Traffic Safety Administration (NHTSA) issues Monthly Recall Reports of all automotive product recalls, including tire recalls.

Aging Tires and Tire Date Coding

Are your new tires really new? An issue that gets less media coverage than tire recalls—but still poses serious risk to life and limb for motorists—is the problem of aging tires that may appear new, but are actually deteriorating from the inside out. For example, many people have a full-size spare tire that came with their vehicle, that has never been used. That tire remains stored away in the car trunk or spare tire compartment of a truck, van or SUV.

The problem is, rubber ages and deteriorates after several years—even if the tire has never been pressed into service. So that spare, when placed on the vehicle after years of being stored away, can suddenly fall apart—causing the vehicle to go out of control. This is true in Florida where the heat adds to deterioration of tire rubber, even in unused tires. Tire failure on the highway can result in devastating injury and death to the motorists.

We advocate that tires older than six years that have never been used should not be sold or driven. Also, tires older than 10 years that are currently being driven on should be replaced. All tires have a "date code" on the sidewall that tells the week and year they were made. See our Florida driving safety and Tire Date Coding webpage for more information.

NHTSA also provides a Tire Labeling website that shows consumers what the other markings on their tire sidewalls mean. Tires are designed to be placed on certain vehicles and used for specific purposes (e.g., passenger car tires have different design features as compared to pickup truck tires designed to haul heavy loads). They also must be properly inflated and maintained for optimum performance and safety.

When a single-car accident occurs and defective or aged tires are suspected, the tire manufacturer, tire retailer, or dealer may hold some responsibility. If you've been in a car accident that you think may have been caused by faulty tires, please contact the Florida tire defect attorneys at Chalik & Chalik at 1-888-539-5297.
